การทบทวนวรรณกรรมที่เกี่ยวกับสถานะสุขภาพและข้อตกลงหรือกฎหมายของผู้ลี้ภัยและผู้ขอลี้ภัยในเขตเมืองในประเทศไทย

การศึกษานี้มีวัตถุประสงค์เพื่อ สำรวจข้อกฎหมายหรือข้อตกลงที่เกี่ยวกับการดูแลสุขภาพและคุณภาพชีวิตของผู้ลี้ภัยและผู้ขอลี้ภัย ในเขตเมือง ในประเทศไทย ใช้วิธีวิจัยเชิงคุณภาพ โดยการทบทวนวรรณกรรมซึ่งเป็นบทความวิชาการทั้งในและต่างประเทศ ข้อตกลงและอนุสัญญาระหว่างประเทศและกฎหมายของประเทศไทยที่เกี่ยวกับสิทธิมนุษยชนและสุขภาพของผู้ลี้ภัยและผู้ขอลี้ภัย วิเคราะห์ข้อมูลโดยใช้วิธีการวิเคราะห์เชิงเนื้อหา ผลการศึกษาพบว่า ประเด็นสุขภาพที่ผู้ลี้ภัยและผู้ขอลี้ภัย มี 3 ประเด็นหลักคือ (1) การคัดกรองโรค (2) สุขภาพจิต และ (3) ประเด็นปัญหาสุขภาพอื่นๆ ทั้งนี้งานวิจัยในประเทศไทยมีจำนวนน้อยมากเมื่อเทียบกับคนต่างด้าวในบริบทอื่นๆ และการที่รัฐไทยไม่ได้เป็นภาคีในอนุสัญญาว่าด้วยสถานภาพผู้ลี้ภัย พ.ศ. 2494 แต่เป็นภาคีในข้อตกลงระหว่างประเทศอื่นๆ ทำให้ไม่อาจเลี่ยงการดูแลผู้ลี้ภัยโดยตรงได้ และไม่นานมานี้ รัฐไทยได้ออก “ระเบียบสำนักนายกรัฐมนตรีว่าด้วยการคัดกรองคนต่างด้าวที่เข้ามาในราชอาณาจักรและไม่สามารถเดินทางกลับประเทศอันเป็นภูมิลำเนาได้ พ.ศ. 2562” ซึ่งไม่พบว่าระเบียบสำนักนายกรัฐมนตรีนี้ทำให้เกิดการเปลี่ยนแปลงที่เป็นรูปธรรมในเชิงนโยบาย ผู้ลี้ภัยและผู้ขอลี้ภัยยังมีข้อจำกัดในการขอใบอนุญาตทำงานและในหลักประกันสุขภาพ ข้อเสนอเชิงนโยบายที่สรุปได้จากการศึกษานี้ เช่น โดยอาศัยระเบียบสำนักนายกรัฐมนตรีว่าด้วยการคัดกรองคนต่างด้าวที่เข้ามาในราชอาณาจักรและไม่สามารถเดินทางกลับประเทศอันเป็นภูมิลำเนาได้ พ.ศ. 2562 ควรมีการจัดตั้งคณะกรรมการอย่างเป็นรูปธรรมและควรเร่งออกประกาศหรือข้อสั่งการในระดับปฏิบัติการเพื่อให้มีแนวทางในการดูแลสุขภาพและความเป็นอยู่ของผู้ลี้ภัยและผู้ขอลี้ภัยโดยเร็วที่สุด และควรมีการศึกษาเพิ่มเติมว่า รัฐไทยควรแสดงจุดยืนให้ชัดเจนในการดูแลคุณภาพชีวิตของผู้ลี้ภัยและผู้ขอลี้ภัยเพียงใด ซึ่งสามารถแสดงออกเป็นรูปธรรมได้หลายทางเลือก เช่น การเข้าเป็นภาคีในอนุสัญญาว่าด้วยสถานภาพผู้ลี้ภัย พ.ศ. 2494 และยกเลิกการสงวนต่อข้อ 22 ของอนุสัญญาว่าด้วยสิทธิเด็ก แต่ทั้งนี้ควรมีการศึกษาเพิ่มเติมถึงข้อดี ข้อเสีย และข้อจำกัดของการเป็นภาคีในข้อตกลงหรืออนุสัญญาต่างๆ ที่นอกเหนือจากมุมมองทางสาธารณสุขด้วย
