บทคัดย่อ

การมีส่วนร่วมของประชาชนในการตัดสินใจระดับนโยบายเป็นองค์ประกอบที่สำคัญของหลักธรรมาภิบาล พระราชบัญญัติหลักประกันสุขภาพแห่งชาติ พ.ศ. 2545 ได้เปิดโอกาสให้ประชาชนมีส่วนร่วมในการอภิบาลระบบ ตามมาตรา 13(4) และ มาตรา 48(8) ที่กำหนดให้มีภาคประชาชนเป็นกรรมการในคณะกรรมการหลักประกันสุขภาพแห่งชาติและในคณะกรรมการควบคุมคุณภาพและมาตรฐานบริการสาธารณสุข บทความนี้มีวัตถุประสงค์เพื่อวิเคราะห์การดำเนินการเพื่อให้เกิดการมีส่วนร่วมของประชาชนในการอภิบาลระบบหลักประกันสุขภาพแห่งชาติและผลจากการดำเนินการ โดยใช้ระเบียบวิธีวิจัยเชิงคุณภาพด้วยการทบทวนวรรณกรรมและการสัมภาษณ์เชิงลึกกับผู้ให้ข้อมูลหลักจำนวน 10 คน

ผลการศึกษาพบว่า ภาคประชาชนมีบทบาทในการอภิบาลระบบใน 3 บทบาท ได้แก่ 1) มีส่วนร่วมในการตัดสินใจเชิงนโยบายผ่านกรรมการในคณะกรรมการฯ 2) สนับสนุนการตัดสินใจของคณะกรรมการฯ ผ่านกรรมการในคณะอนุกรรมการฯ และคณะทำงานต่างๆ และ 3) เชื่อมโยงการทำงานในบริบทของคณะกรรมการฯ อนุกรรมการฯ ต่างๆ กับกลุ่มผู้เกาะติดประเด็นปัญหาระดับรากหญ้า ผ่านเครือข่ายภาคประชาชน ผลการดำเนินการของภาคประชาชนดังกล่าว สามารถผลักดันชุดสิทธิประโยชน์ และความเป็นเจ้าของระบบหลักประกันฯ ของภาคประชาชนในการเฝ้าระวัง ปกป้อง ส่งเสริมและสนับสนุนระบบหลักประกันสุขภาพแห่งชาติให้เกิดประโยชน์ต่อประชาชนอย่างต่อเนื่องด้วยความมั่นคงและยั่งยืน การมีส่วนร่วมของภาคประชาชนที่มีลักษณะก้าวหน้ากว่าที่ระบุไว้ในข้อกฎหมายเกิดจากการเปิดโอกาสให้ประชาชนมีส่วนร่วมในการอภิบาลระบบ และความเป็นพลเมืองที่ตื่นรู้ของภาคประชาชนที่ตอบสนองต่อพื้นที่การมีส่วนร่วมที่เขียนไว้ในข้อกฎหมายได้อย่างเต็มศักยภาพ
