บทคัดย่อ

พระราชบัญญัติการจัดซื้อจัดจ้างและการบริหารพัสดุภาครัฐ พ.ศ. 2560 มีผลบังคับใช้เมื่อวันที่ 23 สิงหาคม พ.ศ. 2560 แทนระเบียบสำนักนายกรัฐมนตรีว่าด้วยการพัสดุ พ.ศ. 2535 ที่ใช้อยู่เดิม ทั้งนี้ เพื่อให้การจัดซื้อจัดจ้างของภาครัฐเกิดความคุ้มค่า โปร่งใส มีประสิทธิภาพและประสิทธิผล และสามารถตรวจสอบได้เป็นอย่างดีเพิ่มมากขึ้น ซึ่งในทางปฏิบัติการดำเนินงานตามพระราชบัญญัติใหม่นี้ มีขั้นตอนและรายละเอียดเพิ่มขึ้น และยังขาดแนวทางที่ชัดเจน ส่งผลให้เพิ่มระยะเวลาการจัดหายาและภาระงานของเจ้าหน้าที่ ตลอดจนมีความเสี่ยงต่อการเกิดยาขาดคราวเพิ่มขึ้น การศึกษานี้มีวัตถุประสงค์เพื่อวิเคราะห์สถานการณ์การจัดหายาของโรงพยาบาลรัฐ ในช่วงแรกภายหลังการบังคับใช้พระราชบัญญัติการจัดซื้อจัดจ้างฯ พ.ศ. 2560 รวมถึงผลกระทบของพระราชบัญญัติดังกล่าวต่อการจัดหายาของโรงพยาบาลรัฐในแต่ละขั้นตอน และเพื่อจัดทำข้อเสนอแนะเชิงนโยบายเพื่อการพัฒนาระบบการจัดหายาในโรงพยาบาลรัฐในอนาคต รูปแบบการศึกษาเป็นการวิจัยเชิงพรรณนา ใช้วิธีการวิจัยเชิงคุณภาพ เก็บข้อมูลโดยการทบทวนเอกสารและการสัมภาษณ์เชิงลึก เน้นการวิเคราะห์ทั้งสถานการณ์การจัดหายาในโรงพยาบาลรัฐกลุ่มตัวอย่างจำนวน 7 แห่ง และการทำความเข้าใจบทบาทของปัจจัยแวดล้อม โดยเฉพาะอย่างยิ่งผลที่เกิดจากกฎระเบียบที่เปลี่ยนแปลงไป การวิเคราะห์ข้อมูลใช้วิธีการวิเคราะห์เนื้อหา ข้อค้นพบที่สำคัญหลังการประกาศใช้พระราชบัญญัติการจัดซื้อจัดจ้างฯ พ.ศ. 2560 ในระยะเวลา 1 ปี คือ 1) โรงพยาบาลมีวิธีปฏิบัติในการจัดหายาแตกต่างกัน ขึ้นอยู่กับนโยบายของต้นสังกัดและการตีความกฎหมายการจัดหายาตามพระราชบัญญัตินี้ 2) ภาระงานเพิ่มขึ้นเนื่องจากงานด้านเอกสารและจำนวนรายการยาที่ต้องจัดหาเพิ่มขึ้น นำไปสู่ภาระค่าใช้จ่ายที่สูงขึ้น 3) จำนวนบุคลากรที่รับผิดชอบจัดหายาของโรงพยาบาลไม่เพียงพอ และ 4) ระบบสนับสนุนการจัดซื้อจัดจ้างยังขาดความพร้อมหลายด้าน ดังนั้น หน่วยงานและผู้ที่เกี่ยวข้องทั้งภาครัฐและเอกชน เช่น กรมบัญชีกลาง สำนักงานตรวจเงินแผ่นดิน ผู้บริหารโรงพยาบาล ผู้ผลิตและจำหน่ายยา ควรวางแผนจัดสรรบุคลากรให้เหมาะสมกับงานและสนับสนุนการใช้เทคโนโลยีสารสนเทศเพื่อพัฒนาระบบเอกสารการจัดหายาที่มีประสิทธิภาพมากขึ้น และควรจัดให้มีการติดตามและประเมินการจัดหายาทั้งกระบวนการและผลลัพธ์อย่างต่อเนื่อง
